Records requests will be available for examination and copying by a Unit Owner or the Owner's authorized agent in compliance with and subject to the Association's governing documents and the Colorado Common Interest Ownership Act 38-33.3-317 and 38-33.3-209.4.
The Association requires a written request:
- Which describes the records requested in reasonable detail
- Which is submitted at least 10 days prior to inspection or production
Examination and copying will need to take place during normal business hours or at the next scheduled Board meeting, if the meeting is held within 30 days of your request.
If the request is for the entire or part of a membership list, your purpose for obtaining the list must be related to your ownership interests. The list:
- May not be used to solicit money or property (unless related to a unit owner election)
- May not be used for any commercial purpose
- May not be sold to or purchased by anyone
- Will include names, physical mailing addresses and voting allocation
- Will not include owner e-mail information
- There will be a charge collected in advance for the costs of labor and material.
I hereby request access to the records of the Association.
I acknowledge and accept that the Association's records will be made available to me, and that there may be a cost associated with providing copies of these documents for me. I agree to pay any costs associated with copying these documents. In the event the documents provided to me by the Association are used for improper use, I will be responsible for any and all damages, penalties and costs incurred by the Association, including attorney's fees, and I shall be subject to all enforcement procedures available to the Association through its governing documents and/or Colorado law.
